Sie wird zunehmend formalisiert und in der gesamten Schweiz harmonisiert. Dennoch lassen das Gesetz und die Rechtsprechung immer noch einen Interpretationsspielraum hinsichtlich der Bestandteile der Berechnung und des Ansatzes offen. Zudem k\u00f6nnen die Richter unterschiedliche Praktiken anwenden. Es handelt sich nicht um eine rein mathematische Angelegenheit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In einem einvernehmlichen Scheidungsverfahren ist der Spielraum noch wesentlich gr\u00f6sser, so dass die besondere Situation der Parteien gut ber\u00fccksichtigt werden kann. Sie entscheiden zu einem grossen Teil \u00fcber die Elemente der Berechnung und bestimmen somit weitgehend selbst \u00fcber das Ergebnis. Bei einem Gerichtsverfahren hingegen \u00fcbertragen die Parteien ihre Entscheidungsbefugnis auf den Richter, der auf der Grundlage des Gesetzes, der Rechtsprechung und seines Ermessens entscheidet.<\/span><\/p>\n<\/div>\n<p>\n<\/div><\/div><\/div><\/div><div  class=\"bt_bb_column col-xl-6 bt_bb_align_left bt_bb_padding_normal\"  data-width=\"6\" data-bt-override-class=\"{}\"><div class=\"bt_bb_column_content bt_bb_vertical_align_top bt_bb_color_scheme_\"><div class=\"bt_bb_column_content_inner\"><div  class=\"bt_bb_text\" ><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Selbstverst\u00e4ndlich ber\u00fccksichtigt unser Simulator sowohl das Gesetz als auch die neueste Rechtsprechung in diesem Bereich. Es handelt sich jedoch um eine theoretische Berechnung f\u00fcr standardisierte Situationen. Ob vor Gericht oder bei einer g\u00fctlichen Einigung mit einem Mediator, die zugrunde gelegte Berechnung kann von den Ergebnissen unseres Rechners abweichen.
